These Terms and Conditions govern the use of the Airsoft 247 Limited website, online store and associated webpages ("the Website"), together with purchases and other transactions made through the Website.

By accessing or using the Website, creating an account, placing an order or otherwise using our online services, you agree to be bound by these Terms and Conditions.

Nothing contained within these Terms and Conditions is intended to restrict or exclude any statutory rights available to consumers under applicable UK law.

Throughout these Terms and Conditions, Airsoft 247 Limited may also be referred to as "Airsoft 247", "we", "us" or "our".

The Website, its operation, branding and business content are controlled by or provided on behalf of Airsoft 247 Limited, except where expressly stated otherwise.

No use of the Airsoft 247 Limited name, trading names, logos, branding or other intellectual property is permitted except with our prior written permission or where permitted by law.

2. COPYRIGHT AND INTELLECTUAL PROPERTY

Unless otherwise stated, original material created by or owned by Airsoft 247 Limited and displayed on the Website, including text, graphics, artwork, photographs, videos, designs, page layouts, promotional material and other original content, is protected by applicable copyright and intellectual-property law.

Copyright and other intellectual-property rights belonging to manufacturers, suppliers and other third parties remain the property of their respective owners.

You may access and display the Website for your own personal and lawful use.

You must not, without prior written permission from Airsoft 247 Limited or the relevant rights holder:

  • reproduce or republish our protected material;
  • copy substantial parts of the Website;
  • commercially exploit Website content;
  • alter or create derivative commercial material from our protected content;
  • use our photographs or promotional material for another business;
  • remove copyright, trademark or ownership notices; or
  • represent Airsoft 247 Limited content as your own.

Unauthorised commercial use of our intellectual property may result in enforcement action.

3. REQUIREMENTS FOR USING THE WEBSITE AND STORE

You must use the Website only for lawful purposes.

You must not knowingly:

  • provide false, fraudulent or misleading information;
  • impersonate another person;
  • interfere with the operation or security of the Website;
  • attempt unauthorised access to the Website, accounts or associated computer systems;
  • introduce malware or other harmful computer code;
  • use automated systems to scrape or extract substantial quantities of Website content without permission;
  • use the Website in connection with fraudulent activity; or
  • attempt to purchase goods where possession, purchase or supply would be unlawful.

Where an account is provided, you are responsible for maintaining the confidentiality of your login credentials and for taking reasonable precautions against unauthorised access.

Certain products may be subject to statutory age restrictions, identification requirements or other legal restrictions.

Where applicable, Airsoft 247 Limited reserves the right to require satisfactory evidence of age, identity, eligibility or other information necessary for us to determine whether a transaction can lawfully proceed.

Providing false information for the purpose of circumventing a legal restriction may result in cancellation of the transaction and suspension or termination of access to our services.

3.1 AGE-RESTRICTED AIRSOFT PRODUCTS AND TWO-TONE IMITATION FIREARMS

You must be 18 years of age or over to purchase an imitation firearm, including an airsoft gun supplied in a two-tone or otherwise legally permitted non-realistic colour.

When purchasing a two-tone imitation firearm through our online store, the purchaser will be required to confirm that they are 18 years of age or over by selecting the relevant age-confirmation checkbox during checkout.

By selecting the checkbox and submitting an order, the purchaser is making a declaration to Airsoft 247 Limited that they are aged 18 or over and are legally entitled to make the purchase.

Selecting the checkbox does not prevent Airsoft 247 Limited from undertaking additional reasonable age-verification checks.

Airsoft 247 Limited reserves the right to verify the purchaser's age before accepting, processing or dispatching an order. We may request suitable proof of age or identification where reasonably necessary.

If our reasonable checks establish that the purchaser is under 18, or satisfactory proof of age cannot be provided when reasonably requested, the order will not be fulfilled.

The order will be cancelled and any payment already received for the cancelled order will be refunded using the original payment method, subject to the normal processing times of the relevant payment provider.

A person under 18 must not attempt to circumvent our age-verification procedures or make a false declaration concerning their age.

Airsoft 247 Limited reserves the right to refuse or cancel an order where we reasonably suspect that false or misleading age information has been supplied or that an adult purchaser is attempting to facilitate an unlawful sale to a person under 18.

3.2 REALISTIC IMITATION FIREARMS (RIFs)

Airsoft 247 Limited takes its responsibilities concerning the sale of Realistic Imitation Firearms ("RIFs") seriously.

A customer must be 18 years of age or over to purchase a RIF. Being aged 18 or over does not, by itself, provide sufficient grounds for Airsoft 247 Limited to sell a RIF.

The sale of RIFs is restricted by the Violent Crime Reduction Act 2006 and associated legislation unless the circumstances of the transaction fall within an applicable statutory defence.

Where a customer wishes to purchase a RIF for airsoft skirmishing, Airsoft 247 Limited must be reasonably satisfied that the RIF is being made available for a qualifying purpose.

For airsoft skirmishing, this concerns permitted activities involving the recreational acting-out of military or law-enforcement scenarios for which the required third-party liability insurance is held.

3.3 ACCEPTED AIRSOFT RIF VERIFICATION METHODS

For customers seeking to purchase a RIF for qualifying airsoft skirmishing activities, Airsoft 247 Limited currently recognises the following verification systems:

1. UKARA – United Kingdom Airsoft Retailers Association

2. S.W.A.T. – P.A.S.S. – Player Approval Site System

These systems provide evidence which may assist Airsoft 247 Limited in establishing the circumstances supporting a customer's claimed airsoft-skirmishing defence.

Neither system is itself a firearms licence, certificate, statutory defence or automatic legal entitlement to purchase a RIF.

3.4 UKARA VERIFICATION

A valid and current UKARA player registration may be used as evidence supporting the customer's stated airsoft-skirmishing purpose.

Where a customer relies upon UKARA, Airsoft 247 Limited will independently verify the customer's registration through the appropriate UKARA verification system available to the retailer.

The customer may be required to provide information including:

  • full name;
  • UKARA number;
  • residential address and postcode;
  • date of birth; and
  • other information reasonably required to identify and verify the appropriate record.

The information supplied by the purchaser must correspond with the relevant UKARA record.

Airsoft 247 Limited will not rely solely upon a UKARA number, membership card, screenshot, photograph or verbal declaration where the registration can be independently verified.

Where the UKARA record cannot be verified, the details do not correspond, the registration is not current, or Airsoft 247 Limited has reasonable grounds to question the proposed transaction, we reserve the right to request additional evidence or refuse the transaction.

3.5 S.W.A.T. – P.A.S.S. (PLAYER APPROVAL SITE SYSTEM)

Airsoft 247 Limited recognises S.W.A.T. – P.A.S.S. (Player Approval Site System) as an accepted method of verifying evidence supporting a customer's airsoft-skirmishing defence.

P.A.S.S. is a player-verification system operated by S.W.A.T. Airsoft.

To achieve P.A.S.S. approval, a player must satisfy the applicable S.W.A.T. criteria, which include:

  • being 18 years of age or over for RIF-purchasing approval;
  • being registered with S.W.A.T. Airsoft;
  • holding the applicable S.W.A.T. membership details;
  • completing the required qualifying airsoft attendances within the applicable qualifying period;
  • satisfying the applicable probationary requirements;
  • providing satisfactory photographic identification;
  • providing satisfactory proof of residential address;
  • having their identity and relevant details verified; and
  • being recorded within the P.A.S.S. system as an approved player.

Membership of S.W.A.T. alone does not mean that a player has achieved P.A.S.S. approval.

The current qualification criteria and requirements for S.W.A.T. – P.A.S.S. are published on the official S.W.A.T. website.

3.6 DIRECT P.A.S.S. VERIFICATION BY AIRSOFT 247 LIMITED

Airsoft 247 Limited has direct authorised access to the S.W.A.T. – P.A.S.S. system for the purpose of verifying customers seeking to purchase RIFs.

Where a customer relies upon S.W.A.T. – P.A.S.S., Airsoft 247 Limited will directly check the customer's details and current approval status against the P.A.S.S. system before completing the RIF transaction.

The customer may be required to provide their:

  • full name;
  • S.W.A.T. membership/P.A.S.S. number;
  • residential address and postcode;
  • date of birth; and
  • any other information reasonably required to correctly identify and verify their P.A.S.S. record.

The information supplied by the purchaser must correspond with the information recorded within the S.W.A.T. – P.A.S.S. system.

Airsoft 247 Limited will not rely solely upon a membership card, membership number, screenshot, photograph, verbal declaration or other evidence presented by the purchaser where the customer's P.A.S.S. status can be independently checked through our direct access to the system.

Where:

  • no corresponding P.A.S.S. record can be located;
  • the customer's details do not correspond with the record;
  • P.A.S.S. approval has not been completed;
  • the customer is under 18;
  • the record is expired, suspended, withdrawn or otherwise not currently valid; or
  • Airsoft 247 Limited has reasonable grounds to question the information or proposed transaction,

Airsoft 247 Limited will not complete the RIF transaction on the basis of S.W.A.T. – P.A.S.S.

3.7 CUSTOMER RIF DECLARATION

Before completing an online order for a RIF, the customer may be required to make the following declaration:

"I confirm that I am 18 years of age or over and that I am purchasing this Realistic Imitation Firearm for a lawful purpose for which an applicable defence exists under the Violent Crime Reduction Act 2006 and associated legislation. I understand that Airsoft 247 Limited will verify the information I have supplied before completing this transaction."

Submitting an order and making this declaration does not automatically mean that Airsoft 247 Limited has accepted the customer's claimed defence or agreed to supply the RIF.

3.8 NO AUTOMATIC ENTITLEMENT TO PURCHASE A RIF

Possession of a UKARA registration, S.W.A.T. membership or P.A.S.S. approval does not create an automatic entitlement to purchase a RIF from Airsoft 247 Limited.

UKARA and S.W.A.T. – P.A.S.S. are verification/evidential systems which assist Airsoft 247 Limited in determining whether the circumstances of the proposed transaction support an applicable defence.

The final decision whether to supply a RIF remains with Airsoft 247 Limited as the retailer.

Airsoft 247 Limited reserves the right to request additional evidence or refuse a RIF transaction where we are not reasonably satisfied that the transaction can lawfully proceed, notwithstanding a UKARA registration or approved P.A.S.S. record.

3.9 OTHER STATUTORY DEFENCES

UKARA and S.W.A.T. – P.A.S.S. relate to our verification of customers purchasing RIFs for qualifying airsoft activities.

Legislation provides other circumstances in which a RIF may lawfully be made available, including certain theatrical, film and television productions, museums and galleries, qualifying historical re-enactments and other purposes recognised by law.

Where a customer seeks to rely upon another applicable statutory defence, Airsoft 247 Limited may require appropriate documentary evidence.

Such transactions will be considered individually and Airsoft 247 Limited reserves the right to undertake reasonable verification before agreeing to supply a RIF.

3.10 FALSE OR MISLEADING INFORMATION

Customers must not knowingly provide false, altered, borrowed or misleading information in an attempt to obtain a RIF.

This includes using another person's UKARA or P.A.S.S. information or attempting to circumvent our verification procedures.

Airsoft 247 Limited may refuse or cancel an order and may suspend future transactions where we have reasonable grounds to believe that false or misleading information has been supplied.

Where Airsoft 247 Limited reasonably believes that information or conduct associated with a transaction should be reported to an appropriate authority, we reserve the right to do so where permitted or required by law.

3.11 RIF VERIFICATION RECORDS

Airsoft 247 Limited may maintain appropriate records relating to RIF transactions and the verification undertaken before a RIF is supplied.

Records may include:

  • the verification system used;
  • the verification reference;
  • the date verification was undertaken;
  • relevant transaction information; and
  • the outcome of the verification.

These records may be maintained for the purposes of demonstrating the reasonable checks undertaken by Airsoft 247 Limited, preventing fraud, resolving disputes and complying with applicable legal obligations.

Personal information obtained or accessed through UKARA, S.W.A.T. – P.A.S.S. or another verification process will be handled in accordance with applicable data-protection legislation and Airsoft 247 Limited's Privacy Policy.

4. OUR RESPONSIBILITIES AND LIABILITY

Airsoft 247 Limited will take reasonable steps to ensure that information displayed on the Website is accurate and that the Website operates reliably.

However, Website information may occasionally contain typographical errors, technical errors, inaccuracies or outdated information.

Product photographs are illustrative and the appearance of products may vary because of manufacturing changes, screen settings or other reasonable factors.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

In particular, nothing in these Terms affects a consumer's statutory rights concerning goods that are faulty, not as described, not of satisfactory quality or otherwise fail to meet applicable statutory requirements.

To the extent permitted by law, Airsoft 247 Limited will not be responsible for losses caused by circumstances outside our reasonable control or losses which were not reasonably foreseeable when the relevant contract was entered into.

Customers remain responsible for using products safely, responsibly, in accordance with manufacturer instructions and applicable law.

5. MODIFICATION OF THESE TERMS

Airsoft 247 Limited may amend these Terms and Conditions from time to time to reflect changes to our business, Website, products, services, technology, regulatory requirements or applicable law.

The current version will be published on the Website together with the date on which it was last updated.

Changes will not retrospectively alter the terms governing a completed purchase unless required by law or expressly agreed between us and the customer.

Continued use of the Website following publication of revised Website-use terms will constitute acceptance of those terms insofar as they relate to future use of the Website.

Customers should therefore review these Terms periodically.

6. TERMINATION OR SUSPENSION OF WEBSITE ACCESS

We may suspend, restrict or terminate a user's access to an account or the Website where we reasonably believe that:

  • these Terms have been materially breached;
  • fraudulent or unlawful activity has occurred or is reasonably suspected;
  • false information has been supplied;
  • the Website or another user is being placed at risk;
  • a legal or regulatory requirement requires us to act; or
  • continued access could expose Airsoft 247 Limited or another person to material legal or security risk.

Where reasonably practicable, we will provide notice of the suspension or termination and the reason for it.

Termination of Website access does not remove rights or obligations which arose before termination.

Cancellation or termination of a contract for the purchase of goods will be dealt with in accordance with the applicable terms of sale and the customer's statutory rights.

7. THIRD-PARTY CONTENT AND LINKS

The Website may contain links to third-party websites, manufacturers, payment providers, booking systems or other external services.

Unless expressly stated otherwise, those third-party services are independently operated and Airsoft 247 Limited does not control their content, availability, security or privacy practices.

The presence of a link does not automatically constitute endorsement of everything contained on the external website.

8. SEVERABILITY

If any provision of these Terms is determined by a court or competent authority to be unlawful, invalid or unenforceable, that provision shall be treated as modified or removed to the minimum extent necessary.

The remaining provisions shall continue to apply.

9. GOVERNING LAW AND JURISDICTION

These Terms and Conditions and any dispute or claim arising from them shall be governed by the laws of England and Wales.

Nothing in this provision deprives a consumer of any mandatory rights concerning where proceedings may lawfully be brought.
